PRIVACY NOTICE
This privacy notice applies to all our current and future co-contractors (including current and former animal owners), external service providers, members, visitors (e.g. visitors picking up an animal for a walk, visitors to our website), adopters, donors, job applicants, volunteers and any other third parties who deal with and whose personal data are processed by the non-profit organization Ligue National pour la Protection des Animaux (hereinafter referred to as the ” Concerned Person ” or the ” Concerned Persons “).
In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing the Directive 95/46 / EC, hereinafter the “GDPR”, we wish to inform the Concerned Persons about the processing of their personal data.
The non-profit organization “Ligue National pour la Protection des Animaux” is established and has its registered office at 6, boulevard de Kockelscheuer L-1821 Luxembourg, registered with the Luxembourg Trade and Companies Register under number F1421 (hereafter referred to as the “LNPA”).
In conformity to the GDPR, LNPA is a data controller.
The legal basis
The legal basis for the processing of the personal data of the Concerned Persons is on the one hand the good execution of our contractual or even pre-contractual relationship with the Concerned Persons and on the other hand the legitimate interest pursued by the LNPA. For certain processing, more than one legal basis may apply (such as for camera surveillance as further described below).
Another legal basis for the processing of the personal data of the Concerned Persons for specific purposes can be their consent. The consent can be withdraw at any moment. If the processing is in parallel based on another legal basis, then the withdrawal of the consent will in principle not impact the processing by the LNPA (or at least not the full extent of the processing).
Another legal basis for the processing of the personal data of the Concerned Persons may also be the legal obligations applicable to the LNPA.

The collection of personal data
Personal data may be collected for example, when the Concerned Persons first contact us, when they fill out any forms or by communicating for instance via phone or email with us and otherwise in the context of their contractual relationship with the LNPA.
Furthermore, personal data will also be collected whenever the Concerned Persons are passing an area where surveillance cameras have been installed. These cameras have as purpose to guarantee the safety of any visitor circulating within our premises, the security of the animals, as well as to control the safety of the material located within our premises (protection against theft, destruction etc.). These purposes constitute at the same time the legitimate interests justifying the video surveillance.
More specifically, cameras have been installed in the following areas: the main entrance to the LNPA building, the sides of the LNAP building and the rear of the LNPA building.
The LNPA guarantees that the security camera footage is kept secure by using appropriate technical and/or organizational measures.
The purpose and processing/use of personal data
LNPA collects personal data primarily in order to be able to fulfil its contractual obligations to its co-contractors and external service providers.
The processing covers the following situations in particular:
- Management of participants (i.e. walkers, members and representatives of public authorities) at events organized by the LNPA. The data collected includes the following: surname, first name, postal address, e-mail address. In principle, data will be kept for a maximum of 5 years. The following persons will have access to the data: the Management, the LNPA Secretariat, the IT Department and, if necessary, external service providers (e.g. Printing Company);
- Administrative management of the non-profit organization (including data processing of members, as well as holders of mandates as members of management bodies). The data collected includes the following: surname, first name, postal address, e-mail address (only for corporate officers), telephone number (only for corporate officers), date of birth (only for corporate officers), photo (only for corporate officers), identity card (only for corporate officers). In principle, data will be kept for a maximum of 10 years from the end of the mandate. For members, data is kept for 5 years from non-payment of the annual subscription. The following people will have access to the data: Management, the LNPA Secretariat;
- Management of inspectors involved in the animal protection mission. The data collected includes the following: surname, first name, postal address, e-mail address, telephone number, date of birth, photo. In principle, data will be kept for a maximum of 2 years after the end of the contractual relationship. The following people will have access to the data: Management, the LNPA Secretariat;
- Adoption management involving the processing of data on future owners/adopters and persons interested in adopting. The data collected includes the following: surname, first name, postal address, e-mail address, telephone number, identity card. In principle, data will be kept for a maximum of 15 years from the date of the first contact. The following people will have access to the data: Management, the LNPA Secretariat;
- Data processing for dog and cat owners. The data collected includes the following: surname, first name, postal address, e-mail address, telephone number, identity card. In principle, data will be kept for a maximum of 15 years from the date of adoption. The following people will have access to the data: Management, the LNPA Secretariat;
- Management of outings/walks, involving the processing of walkers’ personal data. The data collected includes the following: surname, first name, postal address, telephone number. In principle, data will be kept for a maximum of 5 years from the last visit. The following people will have access to the data: Management, the LNPA Secretariat;
- Donation management, involving the processing of donors’ personal data. The data collected includes the following: surname, first name, postal address. In principle, data will be kept for a maximum of 5 years from the last donation. The following people will have access to the data: Management, the LNPA Secretariat;
- Complaints management, involving the processing of data subjects, including LNPA Inspectors and third parties. The data collected includes the following: surname, first name, postal address, telephone number. In principle, data will be kept for a maximum of 5 years from the closure of the complaint. The following persons will have access to the data: Management, LNPA Secretariat, Inspectors.
Consequently, the LNPA will store personal data, inter alia in electronic form and solely for professional use. Personal data may be stored, respectively transferred to any other place of work of the LNPA, to a subcontractor or other co-contractor of the LNPA, as well as to any public administration or authority when legal obligations etc. applying to the LNPA require such a transfer, respectively when the transfer is in line with the purpose of the processing for which the data were delivered to / collected by the LNPA.
In the event of the transfer of personal data to another country, in particular a country outside the European Economic Area, the LNPA will ensure that the transfer is carried out in compliance with the legal provisions in force in terms of data protection, including the GDPR, inter alia by putting in place appropriate safeguards.
Personal data is kept no longer than necessary and in compliance with the purpose for which it has been collected and processed, without prejudice to the right of the LNPA to retain certain data for a longer period due to legal / regulatory obligations applying to the LNPA, respectively because of exceptional situations that would justify a longer storage (judicial procedure etc.).
The LNPA also collects the personal data of candidates interested in a vacancy with the LNPA. If the interested candidate is subsequently hired, the personal data will be retained for at least the duration of the employment relationship and without prejudice to the paragraph above. In the event of refusal, the personal data of interested candidates will be deleted without delay, unless the interested candidate indicates otherwise.
As for the footage collected via the surveillance cameras, the data will automatically be deleted after a period of 8 days.
Who will be in contact with the personal data of the Concerned Persons?
Depending on the concerned data, the persons occupying the following positions are the recipients of the personal data:
- The Management,
- The secretariat of the LNPA,
- The payroll provider/accounting firm
- Outside parties, depending on the case (e.g. law enforcement for surveillance cameras, ADS and Eltrona Security Systems).
Rights
Concerned Persons may assert the following rights:
- the right to be duly informed about the use and processing of the personal data in accordance with the GDPR ;
- the right to access the personal data in accordance with the GDPR;
- the right to rectify the personal data, the right to request erasure of the personal data, the right to object to the processing of personal data provided that constraints and legal obligations applicable to the LNPA do not conflict with such a request;
- the right to obtain in particular situations specified in the GDPR, the restriction of processing so that the personal data may only be processed with the consent of the Concerned Persons (without prejudice to our right to store the data in accordance with the applicable legal provisions). The execution of this right does not impact any previous processing’s;
- the right of the Concerned Person to receive in particular situations specified in the GDPR, all personal data relating to him/her and provided by him/her to the LNPA and to transfer such data to another controller (right to data portability). The LNPA reserves the right to charge a fee for such transfer, especially in case of frequent requests and / or in the event of a request deemed excessive in terms of volume of data to be transferred. The Concerned Person has to inform the LNPA in writing in due course before the end of the contract if he/she intend to make use of this right. Otherwise, the LNPA can not be held responsible for the erasure of the personal data;
- the right without prejudice to any other administrative or legal remedy to lodge a complaint with the national supervisory authority (Commission Nationale pour la Protection des Données – CNPD) if the Concerned Person considers himself/herself being the victim of a breach in the processing of his/her personal data; and
- with respect to video surveillance, the right to access the security camera footage on which the Concerned Person appears.
Website
The LNPA is responsible for the processing of personal data collected through its website (the “Site”).
For the navigation on the Site, the visitor does not need to disclose his personal data concerning him.
During each visit to the Site, certain technical data (the “Technical Data”) is automatically saved in a specific file on the Site’s server. Technical Data may include, but is not limited to, the IP address, the internet service provider, operating system and browser type used by the visitor, date and time of access to the Site, the page(s) visited, the amount of data transferred. The LNPA analyses the Technical Data for statistical purposes as well as for the management and improvement of the Site. The Technical Data collected will in no way be used by the LNPA to profile the visitors to the Site, so that the anonymity of each visitor is guaranteed. Technical Data will not be passed on to third parties.
For the rest, the LNPA’s Cookie Policy, as published on the Site, applies to the processing of personal data collected via cookies.
Amendment of this Declaration
LNPA reserves the right to modify this declaration at any time and for any reason whatsoever. In order to be informed how the LNPA protects the personal data of the Concerned Persons, we recommend you to periodically review this statement on the website of LNPA.
